1. Who we are

Stackfold HQ LLC ("Stackfold HQ", "we", "us") is a limited liability company registered in the State of New Mexico, United States, at 2585 S Broadway St, Unit #295, Truth or Consequences, NM 87901, USA. We are the data controller for the personal data described in this policy. You can reach us at hello@stackfoldhq.com.

2. This website collects nothing on its own

stackfoldhq.com is a static website. It contains no contact forms, no analytics, no advertising, no social media embeds and no third-party scripts. It sets no cookies and does not use local storage. We do not track visitors across this site or any other, and there is no profile of you being built from your visit.

Because there are no third-party scripts, loading this site does not send your data to any advertising, analytics or social network.

3. Server logs held by our hosting provider

The website is served by a third-party hosting provider. Like all web hosts, it automatically records technical request data — IP address, timestamp, requested URL, HTTP status, user agent and approximate region — for the purposes of delivering the site, protecting it from abuse and diagnosing faults. We do not use these logs to identify individuals and we do not combine them with any other data.

The lawful basis for this processing is our legitimate interest in operating a secure and functioning website. Retention is governed by the hosting provider's standard log retention period, which is short-term.

4. Information you send us by email

If you email us, we receive the content of your message and any personal data in it — typically your name, email address, employer and a description of what you need built. We use this only to reply to you and, if we work together, to deliver and administer that work. The lawful basis is our legitimate interest in responding to a business enquiry, and, once engaged, the performance of a contract with you.

Our email is provided by Proton AG (Switzerland). Enquiry correspondence is kept while a conversation is live and for up to 24 months afterwards, so that we have a record of what was discussed. Records connected to a signed engagement, including invoices, are kept for as long as tax and accounting law requires.

5. Client data during a project

Delivering software sometimes means access to systems containing personal data belonging to a client's own customers or staff. In that situation the client is the data controller and we act as a data processor on their instructions. Such access is limited to what the work requires, is covered by the confidentiality terms of the engagement, and is removed on completion. Where the work falls under the UK or EU GDPR, we will enter into a written data processing agreement before that access begins.

6. Who we share data with

We do not sell personal data and we do not share it for advertising. We disclose it only to service providers acting on our behalf — our website host, our email provider, and, where relevant to an engagement, our accountant or payment processor — and only as needed to run the business. We may also disclose data where we are legally required to do so.

7. International transfers

We are based in the United States and work with clients in Europe. Personal data you send us may therefore be processed in the United States and in Switzerland. Where data protected by the EU or UK GDPR is transferred, we rely on an appropriate transfer mechanism such as the European Commission's Standard Contractual Clauses or an adequacy decision covering the destination country.

8. Your rights

Depending on where you live, you may have the right to request access to the personal data we hold about you, to have it corrected or deleted, to restrict or object to our processing of it, and to receive a copy in a portable format. If you are in the European Economic Area or the United Kingdom, you also have the right to complain to your national data protection authority.

To exercise any of these rights, email hello@stackfoldhq.com with "Privacy" in the subject line. We will respond within 30 days. We may ask you to confirm your identity before acting on a request.

9. Children

Our services are sold to businesses. This website is not directed at children and we do not knowingly collect personal data from anyone under 16.

10. Security

The site is served exclusively over HTTPS. Access to our email and client systems is protected by strong, unique credentials and multi-factor authentication. No method of transmission or storage is perfectly secure, but we take reasonable measures appropriate to the sensitivity of the data we hold.

11. Changes to this policy

If we change this policy we will update the date at the top of this policy. Material changes affecting how we use data you have already sent us will be communicated directly where we have a means of contacting you.

Terms of service

Last updated: 1 November 2026

1. About these terms

This website is operated by Stackfold HQ LLC, a limited liability company registered in the State of New Mexico, United States, at 2585 S Broadway St, Unit #295, Truth or Consequences, NM 87901, USA ("Stackfold HQ", "we", "us"). By accessing stackfoldhq.com you agree to these terms. If you do not agree with them, please do not use the site.

2. These terms do not govern our services

Nothing on this website is an offer capable of acceptance, and these terms are not a services agreement. Development work is always governed by a separate written agreement signed by both parties, setting out scope, price, timescales, intellectual property and liability for that specific engagement. Where that agreement and these terms differ, that agreement prevails for the work it covers.

3. Permitted use of the site

You may view and print pages of this site for your own information, and for the purpose of evaluating or verifying our business. You may not use the site unlawfully, attempt to gain unauthorised access to it or to any system behind it, interfere with its operation, or scrape its content in a way that places an unreasonable load on it.

4. Intellectual property in the site

The content, layout, design and source of this website are owned by Stackfold HQ LLC or licensed to us, and are protected by copyright. The name "Stackfold HQ" and our logo are our trade marks. You may not reproduce, republish or adapt the site's content for commercial purposes without our written permission. Names of third-party technologies mentioned on this site are the trade marks of their respective owners, and their mention does not imply any endorsement or partnership.

5. Accuracy of information

We publish this site in good faith and keep it up to date as far as reasonably possible. Descriptions of services, engagement models and technologies are general in nature and may change. Nothing on this site constitutes professional, technical, financial or legal advice, and it should not be relied on as the basis for a decision without speaking to us first.

6. Third-party links

Where this site links to an external website, we do so for convenience. We do not control those sites, are not responsible for their content or practices, and their inclusion does not imply endorsement.

7. Availability

We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it, or these terms, at any time without notice. Continued use after a change constitutes acceptance of the revised terms.

8. Disclaimer

To the fullest extent permitted by law, this website is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be error-free, secure or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Stackfold HQ LLC and its members, officers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, business or goodwill, arising out of or in connection with your use of this website, whether based in contract, tort, negligence, strict liability or otherwise. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation.

10. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your unlawful use of this website.

11. Privacy

Our handling of personal data is described in our privacy policy, which forms part of these terms.

12. Governing law and jurisdiction

These terms and any dispute arising from them or from your use of this website are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico have exclusive jurisdiction, and you consent to venue there. If any provision of these terms is found unenforceable, the remaining provisions continue in full force.

Refund policy

×

Last updated: 1 November 2026

1. Scope

This policy applies to payments made to Stackfold HQ LLC, a limited liability company registered in the State of New Mexico, United States ("Stackfold HQ", "we", "us"), for custom software services and for any software product or subscription we sell. Where a signed agreement with you sets out different payment or refund terms, that agreement prevails.

2. Custom software projects

Project work is priced and scheduled in a written agreement before it starts, and is invoiced in milestones or fixed periods. Because each payment covers work already scoped and scheduled for you, payments for work that has been delivered or performed are not refundable.

If a milestone we deliver does not meet the acceptance criteria in the agreement, tell us in writing within 14 days of delivery. We will fix it at no extra cost. If we cannot fix it within a reasonable time, we will refund the amount paid for that milestone.

If you cancel a project, you pay for work performed up to the date of cancellation, and we refund any prepaid amount for work not yet started. If we cancel a project for reasons other than your breach of the agreement, we refund all amounts paid for work not yet delivered.

3. Subscriptions and software products

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. We do not refund partial billing periods.

If you were charged for a renewal you did not intend, or charged twice or by mistake, contact us within 30 days of the charge and we will refund it. One-time purchases can be refunded on request within 14 days if the product does not work as described and we cannot fix the problem.

4. Your statutory rights

Nothing in this policy limits any right to a refund or remedy that you have under the law that applies to you and that cannot be excluded by contract.

5. How to request a refund

Email hello@stackfoldhq.com with "Refund" in the subject line, the invoice or receipt number, and the reason for your request. We reply within 5 business days. Approved refunds go back to the original payment method, usually within 5 to 10 business days of approval, depending on your bank or card issuer.

6. Disputes and chargebacks

Please contact us before disputing a charge with your bank or card issuer; most issues can be resolved faster that way. Disputing a charge does not affect your rights under this policy.
